On July 12, 2013, the Honorable Elihu M. Berle granted final approval of an $800,000.00 settlement in Morrow v. Avon Products, Inc., Los Angeles Superior Court Case No. BC467304, a wage-and-hour class action against Avon Products, Inc. and Spherion Staffing, LLC that the Law Office of Donald Potter was appointed as co-counsel for the class members.
The class action lawsuit included claims for: (1) Failure to Allow and Pay for Meal and Rest Periods (Cal. Labor Code §§ 226.7, 512); (2) Failure to provide Proper Wage Statements (Cal. Labor Code § 226); (3) Failure to Pay All Compensation Owed at the Time of Termination (Cal. Labor Code § 201-203); (4) Forfeiture of Vacation Pay (Cal. Labor Code § 227.3); and (5) Violation of Business and Professions Code § 17200. The lawsuit also sought civil penalties under the California Private Attorneys General Act (“PAGA”).
The class action settlement covers permanent and temporary employees at Avon’s distribution facility in Pasadena, California who: (a) held the job title “Order Processor,” “Area leader,” or “Bin Filler” regardless of department; or (b) were employed, regardless of title, in on of the following departments: “Bin Filing,” “Closing/Dock,” “Quality-Order Fulfillment” and “Line Stock/Replenish.” The Class Period commenced on August 12, 2007 and ended on February 27, 2013 when the Court granted preliminary approval of the settlement.
The claims rate for Avon employees exceeded seventy-nine percent (79%) and the average settlement disbursement amount to the Avon class members who filed claims was $1,395.00.
